Budget reconciliation is a unique legislative tool. It streamlines the passage of budget-related bills through Congress, bypassing the Senate filibuster – a tactic used to block or delay the passing of a bill by subjecting it to unlimited debate. The reconciliation bill can also be passed by a simple majority in the senate rather than the typical 60-vote supermajority needed for legislation to pass the senate.
This process is typically used as a tool for the congressional majority to pass their agendas given that policymakers rarely agree on important issues in recent times. However, lawmakers must consider the Byrd Rule, which limits reconciliation to matters impacting federal revenue and spending. As such, policies must be crafted within this constraint to be passed under budget reconciliation.
Such legislative efforts often lead to amendments in the process known as “vote-a-rama.” This is a process in a senate session involving numerous rapid votes on potential changes, shaping the final reconciliation legislation. The intricacies of this process make it a crucial space for advancing immigration reform proposals, with many eyes on its outcome.

In December 2021, the democratic party proposed an increased social spending bill under the budget reconciliation. This bill contained proposals for more spending to be allocated to immigration reform provisions extending protections for undocumented immigrants and providing them with potential pathways to citizenship. It also included proposals for work permits for immigrants who have been in the U.S. since before 2011 and the reduction of immigration backlogs.
However, this proposal was struck down as the parliamentarian claimed that the policies had a primary goal of changing immigration policy and that their budgetary impact was secondary, therefore it was not allowed under reconciliation.
The same logic was used to reject an immigration policy under budget reconciliation that would have allowed for the adjustment of the registry date in the Immigration and Nationality Act, potentially granting millions of immigrants the ability to adjust to lawful permanent residents (LPR).
The registry is a provision under US immigration law that allows non-citizens who are long-term residents of the United States and who have been law-abiding residents to apply for LPR status. To be eligible, applicants must have entered the U.S. by a specified date which can only be advanced by congress. The last time this date was advanced was in 1986 and the date was set at January 1,1972 which is very far in the past. This means that unless Congress advances the date to make it more current, the registry is relevant to very few individuals.
Considering the lack of a need for bipartisan agreement before passing policies under budget reconciliation, the majority party in Congress often has the leeway to pass policies including immigration policies that align with their party ideology. With this in mind, one can predict the immigration landscape depending on the party in power.
